The Studer Portal is an Internet platform dedicated to collection, management and presentation of data from technical energy units and systems. This is a service that Studer Innotec SA is offering to all registered users (the “User” or "Users”) of the internet website portal.studer-innotec.com (the “Website”). The Users have the possibility to upload data into the Studer Portal data system of installations with inverters and data transmission equipment from Studer Innotec SA via a technical link. A User can be the facility or facilities operator or a third party acting in the operator’s name or on the operator’s account, for instance the installer of an installation or installations.
Data and services provided or found on the Studer Portal should only be employed for personal use and in line with general commercial conditions. They cannot be commercially exploited or resold. Studer Innotec SA reserves the right to modify the commercial conditions of this service at any time.
Access to the Studer Portal, to the current conditions, is guaranteed for five (5) years from the date of sale of any product that is compatible with this service.
To access the Studer Portal, the User first has to create an account by providing a personal email address as username and then defining a password. The User consents to keep both username and password secure and confidential and never to transfer them to a non-authorized third party. The registration authorizes the User to adjust, search, consult, share and visualize installation data.
In the event of loss or suspicion of abusive use of the log-in information, Studer Innotec SA should be informed promptly. If Studer Innotec SA becomes aware of inappropriate use, Studer Innotec SA has the right to take necessary measures and in particular to exclude the responsible User. An abusive use of connection data is for instance when non-authorized persons make modifications to parameters of the installations, to parameters of corresponding components or to internal configurations of the Studer Portal with harmful effects.
If the Studer Portal is used by a third party, i.e. other persons than the operator of the installation, they have to confirm by their inscription and by accepting these Terms that they have received prior consent from the installation operator to register and to modify installation data of a specific installation within the Studer Portal and as well as retrieving its data.
If necessary, they are committed to prove to Studer Innotec SA the existence of such an agreement with the operator of the installation and free Studer Innotec SA from any claims from the operator of the installation regarding the use of the Studer Portal. Studer Innotec SA reserves the right to exclude at any moment Users of the Studer Portal and to refuse access as long as these Users are not able to justify in a satisfactorily manner that they have official permission from an installation's authorized operator to register and to perform data configuration on the installation using the Studer Portal.
In case of doubt, the operator's instructions addressed to Studer Innotec SA have priority over any third party, which under these circumstances are entitled to no claims from Studer Innotec SA in order to continue to use the Studer Portal, with or without restrictions.
The Studer Portal has been developed by Studer Innotec SA and it is copyright protected. All user rights and licensing are the property of Studer Innotec SA. The User should only use the information and the results of the Internet service within the stated user conditions and for personal use. Studer Innotec SA allows its Users to make installation data available to the public and to make installations available to third parties under the same conditions of use as cited. Only a written authorization from Studer Innotec SA will give permission to use the information and service results for other purposes. Studer Innotec SA does not authorize the resale of this service.
The Users are authorized to upload or to have uploaded information of personal content within the available data space on the Studer Portal. The User has no right whatsoever to demand the publication or the long-term availability of the uploaded contents on the Studer Portal.
The Website shall not be used for any illegal purpose, including but not limited to violating third party’s legal rights, violating laws of any country, and constituting or encouraging criminal conduct. The Website shall not be used to transmit content that could be deemed threatening, harassing, racist, abusive, libellous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate.
